All products are subject to availability. We reserve the right to limit quantities and discontinue any product at any time without notice.

3. Pricing and Payment

3.1 Pricing

Prices are displayed in Australian Dollars (AUD) and are subject to change without notice. Prices include GST unless otherwise stated. We reserve the right to correct any pricing errors.

3.2 Payment Terms

• Payment is due upon order confirmation unless credit terms have been arranged
• We accept major credit cards, bank transfers, and approved trade accounts
• Trade accounts are subject to approval and credit checks
• Late payments may incur interest charges as permitted by law

4. Orders and Delivery

4.1 Order Acceptance

Your order constitutes an offer to purchase. All orders are subject to acceptance by us. We may refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

4.2 Delivery

• Delivery times are estimates only and not guaranteed
• Risk of loss passes to you upon delivery
• You must inspect products upon delivery and note any damage on the delivery receipt
• Delivery charges may apply based on order value and location
• Free delivery available for orders over specified threshold (subject to terms)

4.3 Title and Risk

Title to products remains with Zek Timber and Hardware until full payment is received. Risk of loss or damage passes to you upon delivery.

5. Returns, Refunds and Cancellations

5.1 Return Policy

• Returns must be requested within 7 days of delivery
• Products must be unused, in original condition and packaging
• Custom cut items are non-returnable
• Return shipping costs are the customer's responsibility unless the return is due to our error

5.2 Special Order Items

Important: Special order items are non-refundable and non-returnable. Special order items include:

• Products ordered specifically for your requirements
• Items not normally stocked by us
• Bulk quantity orders
• Custom specifications or dimensions

Please ensure you confirm all specifications before placing special orders as these cannot be cancelled once confirmed with our suppliers.

5.3 Cancellations

• Standard Orders: Cancellations made within 24 hours of order placement are free of charge
• After 24 hours: A 20% cancellation fee applies as we may have already processed or ordered your items
• Special Orders: Cannot be cancelled once confirmed with our suppliers
• In-Transit Orders: Orders that have been dispatched cannot be cancelled

5.4 Defective Products

We will replace or refund defective products in accordance with Australian Consumer Law. Please inspect all products upon delivery and report defects immediately. This applies to all products including special order items where defects are covered under warranty.

6. Warranties and Disclaimers

6.1 Product Warranties

Products come with guarantees that cannot be excluded under Australian Consumer Law. Specific warranty terms vary by product and manufacturer.

6.2 Disclaimer

To the maximum extent permitted by law, we exclude all implied warranties and conditions. We are not liable for any indirect, special, incidental, or consequential damages.

7. Limitation of Liability

Our total liability for any claim arising out of or relating to these terms or our products and services shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

You agree to indemnify and hold Zek Timber and Hardware harmless from any claims, damages, losses, and expenses arising from your use of our products or services, violation of these terms, or infringement of any third-party rights.

• Trade accounts are subject to approval and credit checks
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized use

We may suspend or terminate accounts for violation of these terms, non-payment, or suspected fraudulent activity.

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
